By accessing or using www.insureklick.com or the InsureKlick mobile application (“Platform”) and the services, features, content, or applications offered by InsureKlick Solutions Private Limited (“InsureKlick,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

1. Applicability

These Terms apply to all users (“User,” “you”) of InsureKlick Services, including patients, doctors, hospitals, diagnostic centers, pharmacies, and financing partners.

InsureKlick Solutions Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at D-9, Ground Floor, Sector-3, Noida, Gautam Buddha Nagar, Uttar Pradesh – 201301, India, operates an AI-powered health navigation platform that connects patients with healthcare providers, facilitates consultations, diagnostics, pharmacy orders, and financing (“InsureKlick Services”).

Use of the Platform, whether by individuals, hospitals, or corporates, constitutes an agreement between you and InsureKlick.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law.
If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We reserve the right to terminate or restrict access if false information is provided or if you are found ineligible.

3. Platform and Content Use

The Platform and all its content (text, logos, code, data, graphics, and design) are the exclusive property of InsureKlick.
You may use the Platform for personal, lawful, and non-commercial purposes only.

Unauthorized reproduction, modification, or redistribution of any content or functionality is prohibited.

If you believe that any content on the Platform infringes your copyright, please contact contact@insureklick.com with:

  • Details of the copyrighted material
  • Proof of ownership
  • URL of the infringing content

4. Services Overview

InsureKlick facilitates access to healthcare and related services through:

  • AI doctor matching and teleconsultations
  • Diagnostics and laboratory test bookings
  • Pharmacy and medicine orders
  • Hospitalization coordination
  • Healthcare loans via partnered NBFCs
  • Wellness programs and subscriptions

InsureKlick acts as a technology intermediary and service facilitator connecting users with verified healthcare providers.

We do not provide medical advice or treatment ourselves. All healthcare and financial services are rendered by independent third-party professionals and institutions.

5. User Obligations

You agree to:

  • Provide accurate and complete personal, contact, and health information.
  • Use the Platform responsibly and lawfully.
  • Maintain the confidentiality of your login credentials.
  • Avoid misusing the Platform or impersonating others.

If you register or act on behalf of another person (e.g., dependent or family member), you confirm that you have the authority to do so.

6. Role of InsureKlick

InsureKlick serves purely as an intermediary under the Information Technology Act, 2000.
We connect Users to third-party healthcare providers, labs, pharmacies, and financial partners, but we do not guarantee:

  • Availability, accuracy, or suitability of any service
  • Quality or standard of care by third-party providers
  • Outcomes of medical consultations, treatments, or loans

All disputes regarding medical or financial services are between the User and the respective service provider.

7. Payments and Fees

Some services on InsureKlick require payment (“Paid Services”).
Payments can be made through UPI, Razorpay, or Cashfree.

By purchasing any Paid Service, you authorize InsureKlick and its payment partners to process your payment securely.

Refunds:

Refunds are governed by our Refund Policy. Refunds are only processed when eligible, such as:

  • Cancellation of a consultation or test before service delivery
  • Duplicate payment or failed transaction

No refunds are offered for partially used subscriptions or post-completion of services.

InsureKlick is not responsible for issues caused by third-party payment gateways, banks, or financial institutions.

8. User Conduct

You agree not to:

  • Upload or transmit false, unlawful, defamatory, or harmful content.
  • Post content that infringes intellectual property rights.
  • Use the Platform for fraudulent or malicious purposes.
  • Attempt to access, copy, or reverse engineer the Platform.
  • Introduce viruses or interfere with security systems.

Violation of these rules may result in account suspension, legal action, or both.

9. Account and Security

You are solely responsible for maintaining the confidentiality of your account and password.
Any activity under your account will be deemed your responsibility.

Notify contact@insureklick.com immediately of any unauthorized access or suspected breach.

InsureKlick employs industry-standard security measures and cloud-based encryption (via AWS and related providers) but cannot guarantee absolute protection against all cyber threats.

10. Data Use and Privacy

Your use of the Platform is governed by our Privacy Policy, which outlines how we collect, process, and secure your data.

By using InsureKlick, you consent to the collection and use of your data in accordance with our Privacy Policy and applicable laws.

11. Communication and Consent

You agree that InsureKlick may contact you via SMS, WhatsApp, email, or phone for service confirmations, updates, promotions, or support.
Such communication shall be deemed “transactional” and compliant with TRAI guidelines.

You can opt out of marketing communications at any time by writing to contact@insureklick.com.

12. Limitation of Liability

To the fullest extent permitted by law, InsureKlick, its affiliates, officers, and employees shall not be liable for:

  • Any indirect, incidental, special, or consequential damages.
  • Loss of data, income, or reputation.
  • Any acts, omissions, or negligence of third-party providers.

In no event shall InsureKlick’s total liability exceed INR 1,000 (Rupees One Thousand Only).

13. Indemnification

You agree to indemnify and hold harmless InsureKlick, its directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use or misuse of the Platform.
  • Your violation of these Terms or applicable law.
  • Your breach of any third-party rights.

14. Force Majeure

InsureKlick shall not be held liable for any delay, failure, or disruption caused by events beyond its reasonable control, including acts of God, natural disasters, strikes, war, government restrictions, or technical outages.

15. Third-Party Links and Services

The Platform may contain links to third-party websites, applications, or offers.
These are provided for convenience only. InsureKlick does not control, endorse, or assume responsibility for the content or policies of any third-party site.

16. Termination and Suspension

InsureKlick reserves the right to:

  • Suspend or terminate access to the Platform at any time, with or without notice.
  • Remove or disable content that violates these Terms.

Users whose accounts are suspended for violations will not be eligible for refunds.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of Gautam Buddha Nagar, Uttar Pradesh.

18. Grievance Redressal Mechanism

In compliance with the Information Technology Act, 2000 and Intermediary Guidelines, 2021, InsureKlick has appointed a Grievance Officer:

Complaints will be acknowledged within 24 hours and resolved within 15 working days.

19. Amendments

InsureKlick reserves the right to modify these Terms at any time.
Material changes will be communicated via notice on our website and will take effect upon posting.
